Whether we like it or not, disputes form a part of business life and if you and your company haven’t yet been involved in a dispute, you certainly know someone who has.  Putting your head in the sand is not a good strategy – you need to learn how to steer around disputes and when there is no way to avoid them, how to resolve the issue efficiently.

In an international context, the most common mechanism for international disputes is arbitration, not court litigation.  While it is intended to be a mechanism for businesses, many companies run into pitfalls: drafting unworkable arbitration agreements, not thinking through the financing of the process, spending too much money, and running into delays; These are just some of the problems to avoid.

The mistakes companies make in international arbitration often cost them dearly and results in huge losses, unenforceable awards, or even awards, which get set aside by courts.

MUBASHIR MANSOR (Partner, SKRINE)

Mubashir is a dispute resolution lawyer with well over 33 years of experience.  His practice includes acting as counsel, both in litigation and arbitration, in various areas of law, including commercial and corporate disputes.  He is also the head of SKRINE’s aviation practice.  He is a Fellow of the Chartered Institute of Arbitrators and the Asian Institute of Alternative Dispute Resolution.  Further, Mubashir is empaneled as an arbitrator with the Asian International Arbitration Centre (AIAC) and as an arbitrator and mediator with the Asian Institute of Alternative Dispute Resolution (AIADR).

DR. HARALD SIPPEL (Head of European Desk, SKRINE)

Dr. Harald Sippel is an Austrian qualified lawyer and Foreign Lawyer admitted to the Malaysian Bar.  He heads SKRINE’s European Desk, where is advises European companies on their business dealings in Malaysia.  With approximately 15 years of experience, Harald specializes in dispute resolution and regularly represents clients in international arbitrations.  He is sitting as an arbitrator and mediator, and has previously worked as the Asian International Arbitration Centre’s Head of Legal Services. Harald is also a Guest Professor (Global) at Keio University, Tokyo, where he teaches negotiation, mediation and arbitration.
